U.S. Tax Filing for Koreans (2026): Deadlines, Free Filing, and the FBAR Rule That Carries a $16,000 Penalty

American tax filing is less complicated than its reputation. For a salaried worker with one W-2, it is an evening’s work and often free. The part that actually catches Korean households is not the tax return at all — it is a separate one-page report about accounts back home, and skipping it carries a penalty that starts around $16,000 even when you owe zero tax.

Start with the calendar, then read the FBAR section carefully.

The Dates

  • January 31 — employers must send your W-2. Most people can file in February.
  • April 15 — federal filing and payment deadline (moves to the next business day on a weekend or holiday).
  • October 15 — extended filing deadline if you submitted Form 4868.

The extension trap: Form 4868 extends the paperwork, not the payment. If you owe tax, it was still due in April, and interest and penalties accrue from then. Estimate and pay in April even if you file in October.

State taxes are filed separately, with their own deadlines and their own rules. A few states have no income tax at all.

What to Gather

  • W-2 from every employer you had that year.
  • 1099 forms — 1099-NEC for freelance income, 1099-INT for bank interest, 1099-DIV for dividends, 1099-B for stock sales.
  • 1098 — mortgage interest, or 1098-E for student loan interest.
  • SSN or ITIN for yourself and every dependent.
  • Last year’s return, if you have one. It cuts this year’s work in half.

How to File Without Paying Someone

  • IRS Free File — free guided software if your income is under the annual threshold. Check the current limit at IRS.gov; it changes every year.
  • IRS Direct File — file directly with the IRS at no cost, in participating states. Eligibility and state coverage have shifted year to year, so verify before relying on it.
  • Commercial software — fine for a standard W-2 situation. Watch for upsells that turn a free filing into a paid one at the final screen.
  • A CPA or Enrolled Agent — worth the money for self-employment, rental income, stock sales, an inheritance, or your first year filing as an immigrant. An EA is federally licensed and usually cheaper than a CPA for straightforward international cases.

E-file with direct deposit either way. Refunds typically land in about three weeks; paper returns take months.

Deductions vs. Credits

A deduction reduces the income you are taxed on. A credit reduces the tax itself, dollar for dollar — which makes credits far more valuable.

Most people take the standard deduction and itemize only if their deductible expenses exceed it. Then check the credits: the Child Tax Credit, the Earned Income Tax Credit for low-to-moderate earners, and education credits for tuition. Amounts change annually, so confirm the current year’s figures rather than trusting an old article.

FBAR: The One That Actually Costs Korean Families Money

If the combined peak balance of all your foreign financial accounts — Korean bank accounts, brokerage accounts, insurance products with cash value — exceeded $10,000 at any single moment during the year, you must file an FBAR.

Read that carefully, because three details trip people up:

  • It is aggregate, not per account. Five accounts holding $2,500 each trigger it. All five then get reported.
  • It is the peak, not the year-end balance. Money that passed through for one day counts. Selling an apartment in Korea and holding the proceeds for a week triggers it.
  • Signature authority counts, even with no ownership. If you are on a parent’s Korean account so you can help manage it, that account may be reportable — a very common situation in Korean families and a very common miss.

It is not part of your tax return. FBAR is FinCEN Form 114, filed electronically through the BSA E-Filing System at FinCEN — not the IRS, not attached to your 1040, not mailable. Filing it yourself is free, and it is an informational report with no tax due.

The deadline detail nobody tells you: FBAR is due April 15 — but every filer gets an automatic extension to October 15. You do not request it. You do not file a form. There is no penalty for using it. If you are reading this in August and realize you missed April, you very likely still have time.

The penalties are why this matters. Recent inflation-adjusted maximums run to roughly $16,500 for a non-willful violation and, for willful violations, the greater of about $165,000 or 50% of the account balance — potentially more than the account itself. The Supreme Court’s 2023 Bittner decision at least established that non-willful penalties apply per annual report rather than per account.

Already behind? Do not simply stay quiet. The IRS receives foreign account data directly from banks in over a hundred countries under FATCA agreements, Korea included. The Delinquent FBAR Submission Procedures often result in no penalty at all if you reported the income and were not contacted first, and the Streamlined Filing Compliance Procedures exist for larger non-willful cases. Acting before the IRS contacts you is the entire game. This is a situation worth paying a professional for.

Form 8938 (FATCA) is a separate obligation with higher thresholds — starting around $50,000 in specified foreign assets for U.S. residents, higher for those living abroad and for joint filers. It is attached to your tax return. Many people must file both; neither replaces the other.

How to Know a Tax Scam Instantly

The IRS initiates contact by postal mail. It does not call demanding immediate payment, does not text, does not email, and never asks for gift cards, wire transfers, or crypto. Threats of immediate arrest or deportation are always fraudulent — and immigrant communities are targeted deliberately. When unsure, hang up and log into your account at IRS.gov yourself.

일정부터 보시고, FBAR 부분은 꼭 정독하세요.

날짜

  • 1월 31일 — 고용주가 W-2를 발송해야 하는 기한. 대부분 2월이면 신고 가능해요.
  • 4월 15일 — 연방 신고 및 납부 마감 (주말·공휴일이면 다음 영업일).
  • 10월 15일 — Form 4868로 연장했을 때의 신고 마감.

연장의 함정: Form 4868은 서류 제출을 미뤄줄 뿐 납부를 미뤄주지 않습니다. 낼 세금이 있다면 4월에 이미 만기였고, 그때부터 이자와 가산세가 붙어요. 10월에 신고하더라도 4월에 추정액을 납부하세요.

주(State) 세금은 별도로 신고하고 마감일과 규정도 따로입니다. 소득세가 아예 없는 주도 몇 곳 있어요.

준비할 서류

  • W-2 — 그해 근무한 모든 직장 것.

FBAR — 한인 가정이 실제로 돈을 잃는 지점

한국 은행 계좌, 증권 계좌, 저축성 보험 등 모든 해외 금융계좌의 합산 최고 잔액이 그해 단 한 순간이라도 $10,000를 넘었다면 FBAR를 신고해야 합니다.

여기서 사람들이 걸리는 지점이 셋 있어요.

  • 계좌별이 아니라 합산입니다. $2,500짜리 계좌 다섯 개면 기준을 넘어요. 그리고 다섯 개 전부를 신고해야 합니다.
  • 연말 잔액이 아니라 최고 잔액입니다. 하루만 스쳐 지나간 돈도 포함돼요. 한국 집을 팔아 대금이 일주일 머물렀어도 해당됩니다.
  • 소유권이 없어도 서명권한만 있으면 대상이 될 수 있어요. 부모님 계좌 관리를 돕느라 본인이 서명권자로 올라가 있다면 그 계좌도 신고 대상일 수 있습니다. 한인 가정에서 정말 흔한 상황이고, 정말 흔하게 놓칩니다.

세금보고서의 일부가 아닙니다. FBAR는 FinCEN Form 114이고, FinCEN의 BSA E-Filing System에서 전자로만 제출해요 — IRS가 아니고, 1040에 첨부하는 것도 아니고, 우편 제출도 안 됩니다. 직접 하면 무료이고, 세금이 붙지 않는 정보 신고입니다.

아무도 안 알려주는 마감일: FBAR 마감은 4월 15일이지만, 모든 신고자가 10월 15일까지 자동 연장됩니다. 신청도, 서류도 필요 없고, 이 연장을 써도 불이익이 없어요. 지금 이 글을 읽으며 4월을 놓쳤다 싶으시다면, 아직 시간이 남아 있을 가능성이 큽니다.

이미 몇 년 밀렸다면? 조용히 넘어가려 하지 마세요. IRS는 FATCA 협정에 따라 100개국 넘는 나라의 은행에서 계좌 정보를 직접 받습니다. 한국도 포함이에요. 소득은 제대로 신고했고 IRS로부터 연락받기 전이라면 Delinquent FBAR Submission Procedures로 벌금 없이 정리되는 경우가 많고, 규모가 큰 비고의 건에는 Streamlined Filing Compliance Procedures가 있습니다. IRS가 연락하기 전에 움직이는 것이 전부예요. 이건 전문가에게 돈을 쓸 가치가 확실한 상황입니다.
